Thank you for your interest in Westbrook Print Shop.  

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any Services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

GENERAL PURPOSE

These Terms are between you (“Purchaser,” “you,” “your”) and Westbrook Print Shop (“Company,” “we,” “us,” “our”) for the use of this and other Westbrook websites, purchasing physical art prints,  digital products and/or services (our “Products”) whether through the Company’s website at WestbrookPrintShop.com, any related domains or subdomains (the “Website”), mobile applications or social media channels, or in person. The Company and the Purchaser will collectively be referred to as “Parties,” and each individually as a “Party.”

In addition, by clicking “Add to Cart,” “Buy Now,” or any other phrase on the purchase button, submitting a payment electronically or in-person, or otherwise subscribing through the Website, you are as well agreeing to adhere to and be bound by these Terms and Conditions.

If you do not agree to all the terms and conditions of this agreement, then you may not purchase any Print or use any Services.   Any new products, information or services added to the current store shall also be subject to these Terms.  

We reserve the right to update, change or replace any part of these Terms by posting updates and/or changes to this site.  We suggest that you visit this page every time you purchase products or services from Westbrook and print/date a copy of these terms for your reference.  However, your continued use of or access to the site following the posting of any changes constitutes acceptance of those changes.

 This website is hosted on Shopify Inc. (“Shopify”), an online e-commerce platform providing hosting and website services.

ONLINE STORE TERMS

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, and you have given your consent to allow any of your minor dependents to use this site.

You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

You must not transmit any worms or viruses or any code of a destructive nature.

A breach or violation of any of the Terms will result in an immediate termination of your Services.

PRODUCT AVAILABILITY 

All prints displayed on our websites are subject to availability.  We reserve the right to change or remove a print or other content on the site at any time without notice without liability to you or other third party.  As a small business, we do our best to provide consistent services, but there can be unavoidable circumstances that can affect product availability, including but not limited to supply chain and other, temporary operational disruptions, staffing shortages, etc.  

We reserve the right to limit or refuse/reject a sale or limit the quantity of any of our prints to any person, company, organization or geographic area at our sole discretion. We also reserve the right to change the price of a print or discontinue sale of that print at any time without notice and at our sole discretion.

PRODUCT ACCESS & DELIVERY

Digital Downloads: 

Once your purchase is complete, Westbrook will send an email containing all the art files you just purchased plus instructions for download and suggestions for printing. The email will be titled ‘Your art print downloads from Westbrook Print Shop’, and we encourage customers to check their junk folder if they have not received this email.   An internet connection and personal desktop computer/laptop or a mobile device capable of opening digital prints in JPEG format is needed.  We suggest downloading to a computer or laptop instead of a tablet or mobile phone because 1) mobile devices may not be capable of opening and storing large art files and 2) depending on your selected method of printing your art, a USB port may be required to download to a thumb drive.  While we will make every effort to assist you in downloading your purchased art files, it is the responsibility of the customer to ensure that all necessary hardware, internet connections, operating software and knowledge of their specific system requirements are in place.  No refunds will be offered or liability incurred for the inability to successfully download purchased art prints. 

Physical Prints:  Westbrook Print Shop offers printed-for-you art prints in the following sizes:  8x10, 11x14, 16x20 and 24x36.  Our designs are printed on a Smooth Matte Fine Art 100% cotton rag inkjet paper that is high-quality, archival grade, acid-free, and neutral white in color.  Paper print orders typically leave our studio within 3-5 days of purchase.   Our prints are packaged in either a sturdy mailing envelope or heavy cardboard tube specially designed to protect photographs and artwork during shipping.

DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

We do not guarantee, represent or warrant that your use of our Service will be uninterrupted, timely, secure or error-free.

We do not warrant that the results that may be obtained from the use of the Service will be accurate or reliable.

You agree that from time to time we may remove the Service for indefinite periods of time or cancel the Service at any time, without notice to you.

You expressly agree that your use of, or inability to use, the Service is at your sole risk. The Service and all products and Services delivered to you through the Service are (except as expressly stated by us) provided 'as is' and 'as available' for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

In no case shall Westbrook Print Shop, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, Service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the Service or any products procured using the Service, or for any other claim related in any way to your use of the Service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the Service or any content (or product) posted, transmitted, or otherwise made available via the Service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

PAYMENT AND BILLING

By providing the Company with your preferred payment method, you represent that you: (i) are authorized to use this method of payment, and (ii) authorize the Company to charge that payment method (the “Authorized Payment Method”) for any fees related to your purchase of the Products, including without limitation fees relating to any paid feature of the Website and/or subscription service of the Company in which you have chosen to enroll (collectively, the “Fees”). 

ACCURACY OF BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

All credit or debit cards used in purchase transactions are subject to validation and authorization checks as a normal part of the purchase transaction.  If your credit card company refuses to authorize payment, we cannot complete your order and will not be liable for any delivery delays or cancellations.  We are not responsible for any bank fees or charges that may result from payment refusal by your credit card company. 

RETURNS & DAMAGED GOODS POLICY

Damaged Items

If your artwork arrives damaged, we’ll absolutely replace it for you.  You’ll need to email us at hello@westbrookprintshop.com within 7 days with,

• Your order number

• Pictures that clearly show the damaged part of the art print.  

We’ll get the replacement prints out to you ASAP.

Returns/Exchanges

We’re a small art print studio, and every order is printed and/or framed with care only when ordered, either in-house or by our 3rd party printing/framing partner. so we are unable to offer exchanges, refunds or returns.  

That means we can’t offer returns, refunds or exchanges for:

• Ordering the wrong size

• Changing your mind

• Any other reason besides damage

So please choose thoughtfully.  We’ve made every attempt to describe the artwork in detail, and make sure our website pictures accurately portray the print.  If you have specific color requirements, and aren’t sure about a print, reach out to us at hello@westbrookprintshop.com and we’ll be happy to answer your concerns honestly and with care.  Our only goal is to provide you with art prints you can proudly display in your home!

There are also some great YouTube videos that make it easy to see what size art will look the best for your space.

In addition, failure of an art print to meet your expectations or quality, design or color does not constitute damage or defect.  We have made every effort to accurately describe the art print qualities, paper surface/tone/thickness and provide accurate product images on our website.  But it is impossible to guarantee that your computer, tablet or mobile device will display the colors accurately or that your interpretation of print descriptions mesh with your expectation of value.  We thank you for your understanding and ask that if you have any questions whatsoever, please email us at hello@westbrookprintshop.com before placing an order- we will be more than happy to discuss your needs prior to purchase to ensure a satisfactory purchase experience.

LICENSE FOR THE USE OF OUR PRINTS

By purchasing Prints through our Website, you are agreeing to these Terms of Purchase and, in return, we are providing you with a limited, non-transferable, non-exclusive, revocable, non-commercial, personal-use license (“License”) to use the Products. Sharing, copying, reproducing, modifying, publishing, selling, renting, or otherwise distributing the Products, whether publicly or privately, is expressly prohibited. You are never entitled to use any prints as a part of any commercial venture.  Your limited license allows you to use the Products and any associated materials for your personal use only. 

Prints that are purchased as digital downloads can be stored on a private device (laptop or desktop computer, personal tablet or mobile device) but are otherwise subject to the license terms stated in the above paragraph with the following exception: You may create a physical printed copy of the purchased downloaded print for personal use only a maximum of five (5) times.  Technology now enables the owner of a digital asset to embed a digital watermark not visible on a printed copy.  This would enable the rights owner to identify the origin of a digital asset and track any unauthorized transfer.  

INTELLECTUAL PROPERTY

The Company owns and retains all rights, titles, and interests in the Prints offered for sale on our website.  Nothing in these Terms transfers any intellectual property ownership beyond the limited license described in the above section, and we reserve all rights not expressly granted to you. 

CONSENT FOR USER-GENERATED CONTENT

By submitting reviews, images, creative ideas, suggestions, proposals, contest entries, comments, testimonials, or tags (collectively, “Submissions”) to us on any digital platform including, but not limited to email, website, social media and online reviews, or by postal mail, you agree that we may, at any time and without restriction, edit, copy, publish, distribute, translate and otherwise use these items in any medium any comments that you forward to us. We are and shall be under no obligation (1) to maintain any comments in confidence; (2) to pay compensation for any comments; or (3) to respond to any comments.

We may, but have no obligation to, monitor, edit or remove content that we determine in our sole discretion to be unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms of Service.

You agree that your comments will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your comments will not contain libelous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. You may not use a false e‑mail address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any comments. You are solely responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for any comments posted by you or any third-party.

PRIVACY & PROTECTION OF PERSONAL INFORMATION 

We respect your privacy and are committed to protecting it.  We may use certain information that we collect from you to operate Westbrook Print Shop and provide our Products.  

When you browse the Westbrook Print Shop website, your computer’s IP address is available to us like any other website you may visit.  When you purchase a print, digital download or any service, we may collect personal information like your name, address, credit card information and email address that are necessary to deliver the product and complete the purchase transaction.  We may also ask your permission to send you emails about new products, special offers and other information that may be of interest to you.

We use third-party services to process payment and facilitate delivery of our products and services, including electronic fulfillment & delivery, credit card payment and other necessary services, who will have access to your personal information ONLY for purposes of completing the purchase transaction.

THIRD-PARTY SERVICES, OPTIONAL TOOLS & LINKS

A normal part of the services we offer on the Westbrook Print Shop website is information about other services, products or tools that may be helpful in many situations, including but not limited to buying, printing, evaluating, framing, gift-wrapping, hanging or choosing art prints.  Third-party links on this site may direct you to third-party websites that may provide information and services but that are not affiliated with us.

While we research the products and services we provide information on, we are not responsible for examining or evaluating the content or accuracy made available on these sites and we do not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or Services of any third-party mentioned on our website or social media accounts.

We are not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third-party websites/platforms. Please carefully review the third-party's policies and practices and make sure you understand them before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party products should be directed to the third-party.

Information on additional third-party services, products or tools and links to those websites that may be added in the future are subject to these terms as well.

ERRORS, INACCURACIES AND OMISSIONS

Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).

We undertake no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the Service or on any related website, should be taken to indicate that all information in the Service or on any related website has been modified or updated.

ADDITIONAL PROHIBITED USES

In addition to other prohibitions as set forth in the Terms of Service, you are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service or of any related website, other websites, or the Internet; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl, or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Service or any related website, other websites, or the Internet. We reserve the right to terminate your use of the Service or any related website for violating any of the prohibited uses.

GOVERNING LAW

These Terms of Service and any separate agreements whereby we provide you Products or Services shall be governed by and construed in accordance with the laws of the State of New Jersey.

NOTICES AND COMMUNICATION

When you use our website, you implicitly agree that communication with us will be electronic in nature and in writing. You agree to communicating electronically and that all contracts, notices, information and other discourse that we provide to you electronically constitute legal compliance that communication be in writing.

All notices from you to the Company must be sent via email to hello@westbrookprintshop.com. A notice will be considered  received and properly served effective at the time of sending 

We may provide notice to you by sending a message to the email address provided by you as a part of services provided. Notices sent by email will be effective at the time of sending.

TERMINATION

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

INDEMNIFICATION

You agree to indemnify, defend and hold harmless Westbrook Print Shop and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, Service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

FORCE MAJEURE 

To the extent that any failure or delay in our delivery of the Products under these Terms is caused by or results from acts or circumstances beyond our reasonable control, we will not be liable or responsible to you and the same will not be considered a breach of these Terms.  Such acts or circumstances beyond our reasonable control could include, without limitation, acts of God, fire, flood, earthquake, natural disasters, cyber attacks, terrorism, revolution, insurrection, civil unrest, national emergency, epidemic, pandemic, labor disputes  or strikes, supply chain restraints or delays in obtaining suitable delivery services. 

SEVERABILITY

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

ENTIRE AGREEMENT

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

These Terms of Service and any policies or operating rules posted by us on this site or in respect to the Service constitutes the entire agreement and understanding between you and us and governs your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.
